help,what are my rights now?

i bought something online last wed,had email same day that parcel was despatched.tracked the item on monday,said had been delivered to my garage sunday night 10.02pm? we were in,no card through as usual.rang evans who the parcel is from,rang me back saying it was a mistake and the couriers car had broken down so thats why it hadnt turned up monday either?promised me for tues.no sign,rang yesterday and got delivery refunded and 15% off item when i said they were now offering freed elivery anyway as a promotion.promised theyw ould look into it.
still no parcel,no phone call as promised.what are my rights now? can i demand a refund?i told them i needed the item for an occasion tomorrow,which i do and that i couldnt get out to get a replacement except mon or tues when OH here as am having mobility issues at the min.really dropped me in it.

Contact them by durable means i.e. a letter or email, not a telephone call, stating that you are cancelling the order under the distance selling regulations and require a full refund. You have 7 working days from delivery ( if it does turn up) to do this.
