    If you want to send that letter please do at least remove the multiple question marks. It makes the letter seem very unreasonable.

    People above have mentioned why A&L would be unhappy to do this and I can see their points but understand your frustration at the same time.

    A nice letter to them is more likely to aid your case rather than the overemotional one posted above which comes off as inflammatory and not giving them a chance to deal with the matter before involving the press and ombudsmen.

    The FOS will reject this because you didnt go through the A&L complaints procedure first. Not that theres much of a complaint, just a rant.

    In future, fix your own problems, expecting others to do it for you will always burn you.

    There's a far better use of energy in this case than pursue hopeless causes. While the OP is obviously upset they should shout at themselves (while looking in a mirro) rather than attempt to direct the blame elsewhere.

    OP can I also check your sums?

    You are going to get £310k for your property and buy theirs for £280. This only nets you £30k before fees. I can see you still retain £28k of equity (280k-252k=£28k) but this money is not available to you since it is in the property. If I assume that you have £11k in fees (which is what you have said above) then that will leave you £19k to use against credit card debt.

    If you are interested as a pure exercise I have rewritten the letter in what I think is a more likely to succeed manner. I can post it here if you want to see it and consider if it would suit your needs? I won't promise the grammar is perfect however.

    Dear Sir,

    I have recently been dealing with your Mortgages department in order to arrange for my mortgage to be ported to a new property to release some equity and improve my financial situation. I am unhappy with their response in this matter and would like your input.

    I have had a mortgage with Alliance & Leicester for over 5 years (and been extremely happy with the service provided). However for the last two years I have been attempting to sale my property in order to clear down my credit card debt. Since buyers have been hard to find I feared I would have to consider bankruptcy however a few weeks ago a ray of hope appeared in the form of a house swap.

    I would need to transfer my current mortgage of £252,000 to the new property and approached Alliance and Leicester to arrange this. The application was made on the 13th June and your staff reassured me a few days later that they were rushing through the survey to ensure quick service in this matter. The survey took place and I was told that, although the underwriters needed to look at this, it should not be a problem and that I would also be able to look forward to a £500 drop in mortgage payments when my fixed rate ends in March 2011.

    Having been unable to get updates I discovered on the 28th June (due to mix up over telephone numbers) that in actual fact my transfer request had been declined before the 18th June (before I was reassured everything was ok) due to affordability. I had not been informed of this up until now and cannot really see why this should be the case.

    I make £52,000 a year and my current house is selling for £310,000. I am buying for £280,000. However due to the fact I will be using the £30,000 (or the remainder after fees) to pay off my credit cards I will have less outgoings and therefore be able to afford the mortgage payments more easily.

    Due to Alliance & Leicester’s decision to not allow me to do this house swap I am being forced to stay in a higher state of financial debt and they are leaving me few options but to consider an IVA or bankruptcy. Had I been able to do this house swap I would be in a much better situation and almost debt free.

    I am also out of pocket due to the valuation fees, solicitors fees and taking two days off work to try to sort out the mess created by Alliance & Leicester’s refusal. I am being told that it could take to 56 days to get refunds of these costs, if I am able to at all, which further distresses my situation.

    I am also concerned with the lack of customer service from Alliance & Leicester customer relations during this time, especially as members of staff were still adamant that the survey should take place long after the decision to reject me had already been taken.

    I would hope that you would be prepared to reconsider your decision and have my house swap approved. If you are not prepared to do this I feel I would have no options but to contact such organisations as FOS Ombudsman, The Daily Mail and Martin Lewis. I would also consider recommending to friends and family to avoid working with your organisation that is clearly not prepared to help people reduce their debts in the current economic climate.

    Mortgages themselves aren't ported. The terms are. The remortgaging process is in itself a new application.

    You've drafted a well written letter. But seem to missing some fundamental issues.
    that is clearly not prepared to help people reduce their debts in the current economic climate.

    The OP can sell up, clear their debts and start again afresh. Rather than struggle on as interest rates rise in the future. Many aren't in such a fortunate position So this argument has no foundation in this case.
