Swinton help

Hi Guys, I am new to the forum.

A bit of help needed here. To give a breif history, March 09 I got a new car, took out insurance with swinton, and for some reason they included breakdown cover in there. 3 months later I cancelled the car insurance and was told could cancel that but not the breakdown. Swallowed the bitter pill, and said would pay upto November 09 when it was due to expire and they would transfer this cover to my new car. Come November 09 they sent me renewal letters which I binned. Checked out my bank this week and they have still been taking out payment. Rang up to check why and they said somebody claiming to be my mum had agreed for them to renew the policy, which is solely in my name. I had a problem with my car shortly after realising the cover was in place and in desperation rang up to see if they could sort it which they couldn't. 2 days later I rang the swinton branch and he explained that he needed to speak to his manager as only I can authorise it being renewed and nobody else. Upon ringing back they have said that because I have tried to make a claim they are not willing to cancel. I explained they had breached data protection by speaking to somebody else about my policy and allowing them to renew, regardless of whether or not I had rang enquring about the cover. They said anybody in the house where the telephone number is registered can act as an agent and agree for my cover to be taken out again. Surely this is illegal? What advise would you give me? I have cancelled my Direct Debit in annoyance but want to know how to get a refund for the payment they have already taken. Thanks in advance. Shaun

Swallowed the bitter pill, how does this work?usually either you or the car is covered? if its the car you just change the details and said would pay upto November 09 when it was due to expire and they would transfer this cover to my new car.
