I really need some help my
old lanlord served my notice so I left a month early then the date i was given when I left I owed £1000 in arrears the lanlord kept my deposit
so I now owe 400 I have left and not paid him
but I keep recieving emails (nasty ones) saying
he wants the money and that I need to
pay for all the mould damage when he didn't bother fixing it.
Will he bother taking me
to court doesn't it cost alot
more then 400??

Did you just up and leave a month early or did you serve notice to quit coinciding with a rent period?
Are you aware that mould damage is usually the result of condensation arising from the tenant's lifestyle?
Was your deposit lodged in one of the three schemes?
Did you attend checkout? Is there a dual signed inventory?
Small claims court costs about £50 I think but they need your residential address and evidence of your arrears and the damage. If the deposit was not lodged the S21/ S8 you were served is technically invalid.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -
The deposit was in the tenant scheme I originaly went through a letting agent but kept paying my landlord monthly into his bank account. When i first moved into the property there was no mould after a year a half mould started appearing I was becoming very unwell and
doctors can back me up and the environmental health as it was not
my fault. The lanlord has no proof I owe him money the only proof he has was the last few
months the money wasn't
paid into his bank account can't I just say I paid him in cash??
I don't want to pay him because alot of my stuff was destroyed I have pictures and
to be honest everyone who has seen these pics are
totaly disgusted I have lost more in damages
then what I owe him0 -
So you want to lie to avoid paying money you know you owe? And you want our advice on whether you can get away with it.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. No offence, but its obvious that you owe him £400 rent, people like you make it harder for honest renters to get houses. You cannot just say you paid him in cash, you'd need to show a receipt and I'd imagine him showing statements of you not paying into his bank account would be evidence enough.
As for the mold issue, that is different. If its not your fault you shouldn't pay

In your last post on the subject, you were saying you'd pay him half the £400 you owed.
Does he have your address?
If so, it will only cost him £35 to submit a claim against you online. I'd say that's worth it...0 -

I don't know whether that would be classed as contempt of court or the even more serious crime of perjury but both deservedly carry a prison sentence.Every generation blames the one before...

I love the way landlords always blame their tenant for condensation. Nothing at all to do with the landlord not having adequate enough ventilation fans installed of course. I suppose they expect the tenant to have windows wide open all winter to stop condensation too. lol
Condensation is usually caused by lifestyle, whether a tenant or not! Do you know how much water vapour each person produces in their sleep? If you jump out of bed, leave the curtains closed, the windows closed & go to work, this moisture has to go somewhere.
Ventilation does not mean having the windows open all the time. It is simply necessary to create a flow of air - opening two windows on opposite sides of the room/flat by simply a centimetre would do this. Most modern double glazed windows have trickle vents or can be locked very slightly open. Or flinging the bedroom windows open for 5 mins in the morning whilst you have breaskfast, & closing them before you leave for work.
Of course bathroom & kitchen extractor fans help, but only if the tenants actually use them. Often bathroom fans are switched off as they make 'too much noise'
Likewise, I often see complaints that the dehumidifier did not work. It helps if it's turned on, the collection tray/container is emptied, & the windows are not fully open - otherwise you are trying to dehumidify the garden.0
