Faulty Goods - Returns

I purchased two electric scooters from an ebay.co.uk PowerSeller ME which were listed as
item location: UK
post to: europe
Although the selling member is shown as German I should have been suspicious when they arrived with French instructions and a european plug.
After purchasing plug converters, and my daughters using them for a week, one has developed an electrical fault. As the listing stated "We grant 2 years warranty on all our products" after numerous emails & faxes, they have asked me to ship the scooter off to Germany [which will cost £38.40 - more than the cost of the scooter]. As the item appears to have been incorrectly listed is they anything that eBay can do? Suggestions welcomed

Return these items to the sellers destination instructions. You need to make sure the seller is going to refund you this postage because its not your fault you they have developed a fault.0

Did you use paypal if so start clawback procedings as you are obviously dealing with a shyster.Four guns yet only one trigger prepare for a volley.Together we can make a difference.0

Thanks for your replies. I paid via PayPal and I've emailed several times over the last three days asking for them to either arrange collection or confirm that the £38.40 will be refunded - so far without reply. As the 2 years warranty is not further clarified on the listing, the danger is if I pay up front they may turn around and refuse refund. If they fail to reply and I commence Dispute Resolution via PayPal, I'm unsure that it qaulifies under "significantly different from what was described in the listing."0

PayPal Resolution Centre "Goods significantly not as described" claim:
"Our investigation into the following transaction is complete. As stated in our User Agreement, the claims process only applies to the delivery of goods. It does not apply to complaints about the attributes or quality of goods received. Therefore, we are unable to reverse this transaction or issue a refund."0 -
Oh dear. Sorry to hear that, so you havent been issued a refund etc. Even if you won the dispute you would have had to return the goods at your cost - and hope that the seller would refund you for the return postage too, I realise that this does sound unfair but thats life.
Did the item descirption say anywhere in it that it was or wasnt a UK fitting? Surely you could expect that if you buy something from ebay.co.uk and unless it says differently that it has UK plug and instructions. I would try contacting paypal or ebay and see what they say and if they can explain why what you have experienced isnt item not as described.
Is there no other dispute or means to go through? Do you know anyone that may be able to repair the item for you?Weight Loss - 102lb0 -

The eBay Item Description merely stated "Delivery incl. Power pack to load (charger) and a bell, which can be put off and on"
After contacting both PayPal and eBay, as long as the goods are actually received, they don't seem to be particularly interested.
Unfortunately I don't know any electricians so the cost of investigations/repair wouldn't be cost effective.0 -
What is the fault with the scooter ?0

When the power lever is pressed, the motor is meant to 'kick in' when the scooter is moving - most of the time it refuses to kick in . . . . but ocassionally it does but then cuts out again after 100 meters or so and then refuses to budge again.0
