Hello all,
I have had the following letter through the post this morning. A couple of things don't add up, mainly that they say CCUK have been in contact recently by way of telephone and letter in order to resolve the matter of the above mentioned unpaid debt - that is not true they don't have my telephone number.

If anyone could give me some advice then that would be great.

    I would imagine its just a standard letter which is why the telephone part has been incorrectly included. Its certainly a standard threat-o-gram in terms of all the uses of the word may take legal action etc.

    What is the rest of the situation with the debt? Do you agree you owe it? have you spoken to connaught at all or responded to their letters?
    have you asked for proof that you owe the money and that connaught have the right to collect it.

    Personally I would totally ignore this letter and to continue to deal (or follow the usual process) with connaught.

    You are probably aware of this but connaught are part of 1st credit, they are a wholly owned subsidiary.

    I made a couple of payments very low amounts. I asked for a copy of a CCA from 1st credit about 18 months ago, then about 12 months ago they sent me something but I just ignored them. And then cc sent me a letter last week and then this morning this came through the door.

    Well I'd start by sending connaught the prove it letter http://forums.moneysavingexpert.com/showpost.html?p=11570893&postcount=2. And if they do prove it move on to a CCA request.
    Then get niddy or someone to see if its an enforceable CCA.

    Other than that the alternative might be to ignore them (unless you actually ever did get court papers-which doesn't seem that likely after this amount of time).

    Hi Downandout, You gotta follow the whole CCA process through mate. Do you still have what they sent you? You could send the original lender an "Account Sold" letter but without knowing what they originally sent it's difficult to know what details that hold on you. Thanks for posting mate.

    I have never been sent an "account sold" letter by anyone. The original lender was HFC bank. I was under the impression that they were part of the same group as 1st Credit. I know that couugnaught are part of the same company as 1st credit. I do have the CCA thing they sent to me, and this was way after the time scale allowed, I foolishly thought that this was no longer applicable because of that. Then this week I start to get corrispondence from them again. The account defaulted in 2007 so this is 3 years in, and still no court action. I do remember having a conversation about 3 telephone numbers ago when I told them to take me to court etc but they just backed off and I didn't hear anything from them for over a year :s

    No, YOU send original lender an "Account Sold" whilst in dispute. Did they send you the CCA as requested? Was it valid? Can you post their repsonse here ( obviously remove personal details) and I'm sure we can get someone to validate it's legality!

    This is a scanned copy of the CCA request reply. Another 2 pages were included, one was info around the PPI and the 5th page was a copy of the Terms and Conditions of the PPI (I later got this back) I got this in March of 2009 and requested it in July 2008.
