Returned item SNAD but seller not collected from post office

I sent an item back that was SNAD after opening a case, and it says online that they tried to deliver it on 21st June but the seller was out and now it's in the sorting office. I'm worried that they are deliberately not collecting it cos then they won't have to refund me. The seller has been less than pleasant and sent this message 3/4 days after opening the case:
see you havent returned the jacket made enough fuss about it where is the jacket ????????
I have contacted ebay but no response yet. anyone know what will happen? If he doesn't collect it, it will be returned to me and i'll lose out on the return postage AND the original buying costs

Attempted delivery should be enough for you to win the case. Try giving ebay a ring and explain the situation.

As ES phone them and tell them that the item wasn't accepted you should get refunded no problem.

Did you put the tracking number into ebay dispute?

I sent something SNAD back 2.5 weeks ago, and just phoned ebay 2 days after the attempted delivery, and I was given a refund 20 mins later. Seller STILL hasn't bothered picking it up!

(what happens to uncollected special delivery items??)

SD: returned to sender after 3 weeks
RD: 1 week

Yes ebay has the tracking number, I sent it recorded delivery with royal mail
