It's a Peter Rogers production (same as most of the Carry On films), so I doubt it's in the public domain. Had a look around, and can't find it anywhere on public domain sites. I think your seller is telling you porkies.

The distribution company was Anglo-Amalgamated Productions which was bought up by EMI in 1971.There's every chance EMI owns the copyright.
After some more searching, I found this:

Seems a company called Leisureview Ltd submitted it to the BBFC in 2002 for video classification. I guess they own the copyright.

For me the issue would be the picture on the ad showed a normal DVD in a case - giving you the impression you were getting a genuine item - and what tuned up was a copied DVD in a thin cardboard wallet.

this person sold you an item that was clearly not as described. the copy of the DVD will be of lower quality than the original. what if you want to sell it on?
If I were you I'd aks him to refund you fully including postage otherwise you'll escalate it with ebay. he'll be too scared too leave neg feedback and/or you could leave neg feedback warning others he's seling copies or.... there are lot's of options.
Quite a few peeps are into this reporting mularkey. i'm not one of them but i'm happy to threaten people that i'll report them as it's usually enough to resolve a situation.
also when buying DVD's always try and seek out those listings that say "genuine" or "authentic".Snootchie Bootchies!0 -

I am going to get back to him about this.
He doesn't say it's a copy and the picture is definitely cropped to make it appear as though it's the original.
I haven't tried to view it sshnuke but you are right, I dread to think what a copy of an old video looks like.0
