sending an Interim Charging Order

Hi all,

Can anyone please help?

I have just picked up an Interim Charging Order from the court which I am sending to the Land Registry.

However, I have also been given the debtors (that used to be my old LLs) copies and been told to pass them on. The court has ordered that:

"The judgment creditor is to serve this order, original application and all supporting documents at least 21 days before the hearing date on the judgment debtor"

This may seem rather trivial but I want to make sure, at this point especially, that I get things right...

Can I just send them recorded delivery????

I ask because, going back to when I was applying for the CCJ, I sent everything over RD and the debtors never signed for them so I'd be unsurprised if the same happened this time round.

Will this be OK or is there more that I need to do?

Thanks a lot!!!

you will have to prove to the court that you have "served" the papers... either take a witness with you and hand deliver them, or ask a process server to take the papers to the house and personally give them to the old LL. Each person should sign a Statement of Truth to say this is what you have done... OR send copies of all docs via first class post, getting proof of postage, and send them from different post offices on different days.... or.. tape them to the front door with a copy of that days newspaper taped to them and take a photo.....

dont whatever ever you do send them where a signature is needed.....

    Thanks Clutton

I don't really have the money to spend on having a process server deliver them.

About the sending by 1st class post thing... so can I just send, say, 2 different copies (with proof of postage) from 2 different POs on two different days? Would that be sufficient?

I wouldn't particularly want to go over there myself unfortunately.

    Thanks as always!!!

In short yes. Court accept one piece of mail going missing in defence, not two on different days.
If you've have not made a mistake, you've made nothing
