Help Buyer filed fraudulent Paypal claim

I recently sold a brand new Citizen Ladies dress watch WR100m. Buyer got in touch 10 days later to tell me watch had misted up first time she had used it and wanted me to send one that worked.
The killer part was she said she bought it for diving.....arghhh
These watches are not made for diving.
I suggested she put in a claim with Citizen on her warranty...
Got a negative for my trouble.0 -
hi everyone
To the chap/lady who wanted to block her from their ebay shop
Her ebay id is ***********
and her email address ************
thanks for all the comments - they have been a great help - ive been really stressing over this. Ive had 3 more emails from her tonight - heres a cut & paste of the latest
'hi you will refund me in full
asproduct was faulty manufactured your company has now been reported to trading standards. In accordance they have seen and pictured the item i have now been instructed by them to return the item for full refund.
sent by recorded delivery 1st class dp 138012902GB.
As a lady of high calibra i expect no fuss in refund issues
cpallett'
I cracked up laughing at the last para i must admit! wonder what size caliBRA ?
The silly thing is that i had two other ladies contact me the same day - one had changed her mind about her hat and didnt like the dress shed bought so the hat i sold her no longer matched the new outfit (!?) she asked for the same hat in a different colour but i didnt have one so i thought id just give her a refund and be nice. She was made up and i know i'll sell the hat again. Another lady hadnt read the listing properly and was dissappointed that the hat was faulty even though id listed it as such, but she was so polite that i gave her a refund too! We all make mistakes reading listigns dont we. So the point i'm making is that im not some callous ebayer who treats all my buyers crap - i have regular customers because of the customer service we provide - but this woman was rude and called me a cheating liar from the first email - she's also obviously some sort of nutter because im now getting emails nearly every 2 hours!
Ive been trading on ebay for 2 years now and this is only the third problem person ive come across - the other two were non payers in the US.
Think i'll go and drown my sorrows in a vodka & coke and try not to take it too personally (this sound advice came from my 12 year old son! lol)
thanks all for being a great sounding board

I've had some problems with selling clothes before. I sold a coat that my Mum had bought but had never worn before as he changed her mind about it. In the item description I said that it was a small size 14. But I take it my buyer didn't read that as a few days after I posted it she emailed me saying that it was ripped and that she wanted her money back.
She only started to back down when I asked for the item back to check it first. It turns out in the end that it didn't fit her and so in the end she sold it on as it was too much hassle to send it back.
So basically, it could be that your buyer just doesn't want the item and is trying to pester you into giving a refund.Titch

I agree with this, selling clothes is a real problem sometimes.
I've had one recently, as soon as she won my auction I knew she was going to be a problem, she sent hourly updates asking me whether item was posted she paid late in the evening so I just kept telling her that PO wasn't open until next morning. The next morning she e mailed me to say that she had 'caught' one seller lying about when he posted her item, he had said it went at lunchtime but the time stamp on the pO label said early afternoon, and so she left him a neg!
Oh yes, forgot to mention that she has left more negs and neutrals than she had positives, all abusive.
I made myself late for work by sending her item first thing and she emailed the next day to say how nice this item was. She also emailed after the weekend to say she had worn it and was still pleased with it and had leftt me positive feedback.
Then on the tuesday morning I get an irate e mail from her accusing me of having made a profit at her expense. I sent a very non comittal reply and immediately got another email telling me that having worn this item all weekend she decided she didn't want it after all. However, I did not have a refund policy and she was going to report me to ebay for that! so, she had phoned the shop and they confirmed she could have a refund but, shock horror, she had paid me more for the item than I had actually paid for it.
I decided that as feedback had been left both ways already that I would just block her from bidding and ignore her e mails in future.

jamieh..mods can you please remove the buyers email address for the earlier post. It is against ebay terms and conditions to put contact details in a public forum.
The user name is fine to stay.

unfortunatley, tracking numbers with royal mail now mean nothing as the address is not displayed on the website
paypal TOC ".........has to be online trackable....."
i've confirmed this with the a#holes at paypal and ROYAL MAIL deliveries can NOT be used for claims, only couriers such as business post, ANC, etcmoney saving my @rse.
I've spent 10x as much as I would if I had never discovered this website :-)

My information is different to yours as paypal still close disputes where a recorded delivery tracking number is available. THis is because in a dispute the recorded delivery slip retained by the seller and stamped by the post office clearly shows the buyers address.
The only post office tracking method not accepted by paypal is that used for parcels as it cannot be linked online to an address, the tracking is for insurance only.
Anyway, the post office themselves will accept their own recorded (and special delivery) receipts for insurance purposes. So in the unlikely event of a paypal chargeback due to the tracking number showing non delivery, the sender can claim direct from the post office. This means that a buyer can be refunded by the seller and the seller can then claim back from the post office.

well
today ive had 5 emails from her saying shes going to take me down! so i did as suggested and blocker her, also reported her harrassment to her IP provider and ebay but now her son is emailing me telling me the stuff i sell is crap and looks like its been made on Blue Peter (lol!) - whats funny is that i only have one negative feedback for quality and that is from her - the other 1500 feedbacks i have are all positive and the last lot plain to see are all really gushy - so gushy they are embarising(sorry can never spell that) but ladies are obviously loving the hats! Trading Standards are backing me and said today that even if i was in the wrong the burden of proof to actually prove the item was sent out faulty is up to the buyer. Because i am actually trading as a business ( yes i even pay tax on my ebay sales - lol) then the Sales of Goods act applies to me but wouldnt apply to normal private individuals selling an item.
The lesson ive learned is even when im in the right, dont refuse a refund because the hasle isnt worth it - another of her emails today even talked about death and what it feels like having someone close to you die and i wouldnt know what it feels like until i experience it! its getting very scarey now.
