Help with Disability Element of WTC

Hello,

I am hoping someone could help me with the disability element of WTC.

I have been off sick for over 7 months, I have disc damage, and suffer from very painful back pain.

I am still employed, and as my 28 weeks of ssp have ended I am now claiming contribution based esa.

I visited my advice centre yesterday who told me I could claim the disability element of wtc, so I called this morning, and spoke to an advisor.

They told me they would have to 'end' my work details on the system, and re-calculate my earnings, but I would not be eligible for this benefit as I am not in work.

My partner works full time, so not sure if this is why.

Checklist on internet says you have to have been claiming a mix of ssp/esa for 28 weeks which I have, so can anyone shed any light as to why I have been refused it?

    When asked the hours you worked did you say none as you're not in work at the minute or did you tell them your usual hours? As it sounds like they think you're not working.

    My partner earns 13,000.

    I did say I was still employed by the company, but the advisor said they would need to end the employment on the system, because of the 28 weeks ssp.

    Sounds odd and like they think you're no longer in employment, which is why you can not get the TC.
    They need to know you are still employed and are going back to your job when you are no longer sick. You might be best going back to the advice centre and getting them to help you with this.

    I know it does sound odd, I did explain I was still employed by the company and have been for over 10 years.

    The advisor said once I go back to work I will need to ring them back up.

    I have been looking at other jobs, as the one I currently do is desk based and this is when my back is at its worst, I wonder if I could claim this once I got back to work.
