Barclays causing big problems
Options
Hi,
I have an IVA since March this year. One of the creditors was Barclays. I had my personal account with them - I had on overdraft of £2800 that was part of the IVA. This was my sole account no one else had access.
My partner had a savings account with Barclays. I became a joint account holder with this account only. This was never overdrawn (did not have the facility) and when we left barclays £0 balance.
Now they have sent a letter to her demanding full payment of £2800 from my account...how on earth is this possible - she never had access to my sole account and it was not a joint account. What shall I do?
Please help me!

If it had been the joint account then yes they would be entitled to reclaim the debt from one or other of the names. If you had left money in the joint account they would have been entitled (or at least they'd have tried) to offset the money in the joint account against monies owed on other accounts. But if the debt was in yourt sole name then they do not have a leg to stand on... chancers!
(rememeber to put your reference numbers and details on the letter!)Would you ask the wolves to look after the sheep?

Thought as much! Ha just called them they said they thought that account was a joint account - I am now faxes statements and correspondence that proves it my SOLE account.
Idiots!
