You will still need to pay a first visit fee which is about £24.50. They might get away wirth the second visit fee because they did not do a legal levy. They can whistle for the rest.

What you ned to do next is to write to Jacobs, pointing out they do not have a legitimate levy. Copy your local councillor into the letter, then go and see him./her. Get the revenue office to tell Jacobs where to get off.

Thanks you're a star! I've just been looking at http://www.bailiffadviceonline.co.uk/ it's a brilliant website which tells you exactly what they (bailiffs) can and can't do - some interesting case law too on charges - I'd recommend anyone with bailiff issues to have a look at it - as well as coming here of course! :D Who are the Revunue Office btw?

One final questiont RAS (tho I'm sure I'll think of something else!) as the Bailiff is not allowed in my house unless I let him in, does that mean he is not allowed in my back garden either? Is it trespass if he does try to get in? (not that there is a great deal for him to take from there anyway). On the basis that I've transferred my car and don't let them in to do a WP, am I "safe" from his clutches?

    basically you are safe.

Yes the web-site is great. It is run by Herbie21. Unfortunately she now only posts in response to pm as she got a lot of abuse from trolls.

The rEVENUE OFFICE IS THE DEPARTMENT THAT COLLECTS ct. yOUR COUNCILLOR CAN Persuade them to call off the bailiffs or rap their knuckles for trying to charge illegal fees.

Yes, i thought that was Herbie's website. It's excellent. I think then that I will just continue to pay the £100 per month until I've cleared the £289 plus costs and complain to the council in the meantime. Haveing looked at the letter they sent me again, my payment date is actually the 23 of each month - i had just paid it early before, so it's actually only a few days past due!

Just a little update. I've spoken to the Council Tax office this am and explained the position and they are putting the bailiff on hold for 14 days, to give me time to raise my complaint in writing. I've also discovered that I am entitled to a 25% discount in my CT as I am a full time student and OH is therefore classed as the only adult occupier :j They have said that they will backdate this to include last year, which means that by the time the discount has been applied , I should only have a small balance outstanding and Jacobs can go whistle! Obviously, I'll get a discount on this years' CT as well, which I shall of course keep up to date !:o

Thanks so much again for all the help :T

I can get the car transferred to my mum or dad, but how can i do that officially before tomorrow?

Christ you are making life hard for yourself here.
Its council tax and therefore a PRIORITY debt!

You have also said you can clear the balance, so why not just do that and save yourself, your family and people in your street the embarassment.

bailiffs only get there money if they are successfull, if they dont succeed in getting your money within a set time frame the debt is returned to the court and the bailiffs charges are REMOVED!, sign the stat declaration, present it to the bailiffs , they go away as do the bailiff's fees, you then contact the court and make a payment offer for the outstanding amount (less the bailiff fees of course as they did not do there job successfully), if you have concerns about the TRUSTWORTHYNESS of the person who's name is on the affadavit simply destroy it along with and copies after the bailiffs have "jogged on", locking your windows is one way but who wants to live like that? My home is my castle and not my prison, so 1/2 hour and £5 is all it takes to completely remove any and all bailiff's fees , i think they usually get 3 chances to get you to pay up then they have to return it to the court as unsucessfull, although this may differ slightly for council tax and rent arrears, *simples*

No, I said I could clear the COUNCIL TAX balance not the bailiffs fees and even then I said I would have to rob peter to pay paul and I have plenty of other "priority" debts beleive me. If I was rolling in cash I wouldn;t be in this position in the first place - clearly

And for your info - my parents are fully aware of my financial situation and are extremely supportive. I can't help it if bailiffs who can't do their job properly levy on the wrong car!

You dont have to justufy yourself to this troll you came here for help not to be judged and criticised, simply ignore him/her they obviusoly have the perfect life and need not worry about such things to be so judgemental!

Gald to hear it has all worked out for you well done :)

Must be a huge weight of your shoulders I know I have been in this position and still am to a certain extent it really takes its toll.

Dont let the neg heads get you down that is the only problem with this place, there are some wonderful people here with fantastic knowledge that are alsways ready to lend a hand and advise where they can, then there are a few muppets that have nothing useful to say and simply suffer from keyboard diarrhoea shame they have nothing better to do with their day.

    all the best :)
