Buyer saying item is fake

    Hi OP if the buyer has started a dispute on the grounds it is a fake they now only have 10 days to provide proof on letterheaded paper.
    If they do not provide paypal with the correct proof they need to the claim will be closed in your favour and the funds released.
    Also remember after all the dust settles and if you win when feedback is left for you if they mention the words fake or paypal dispute in their feedback to you phone ebay and the feedback will be removed as the dispute was found in your favour.

    Hi, know its been a while but thought I would update this.
    In the end the buyer won the dispute, got their money back, kept the shirt and neg'd.
    My Dad spoke to ebay who removed the neg and said the account was being used by someone other than the buyer and it was now going to be back in the buyer's hands so to speak. Dad asked why they got a refund and kept the shirt but no reply was received and obviously nothing received back.

    Then I'd insist on pursuing this, as you should either get the shirt back, or the money. Phone ebay and demand one or the other!

    Yeah, this is a bit strange, as eBay normally make the buyer send the item back during a dispute for Not As Described.

    Always better to make 100% sure that any items you are selling are genuine, particularly when they're not your own.

    Note that feedback extortion isn't just threatening a neg - it has to be demanding something extra. A cross buyer is going OTT to say in initial emails "Accept a return or I'll neg" but it's not absolutely against the rules: it's just someone who's annoyed and going at something like the proverbial bull in a china shop. What would be extortion is saying something like "Give me a discount or I'll neg".

    If an item is Not As Described it's reasonably good manners for a private seller to refund return postage even though you don't have to.

    If buyer has proved the item was a fake then that is the only instance that paypal do not require its return. It is not legal to buy or sell fake sin the UK.

    However paypal rules are very stringent, the buyer would have needed a checkable letter on headed notepaper from the manufacturer or retailer seller with right to sell confirming legally the item was fake (as was said above). It therefore seems likely on balance that buyer could prove item was a fake.
