Housing Benefit claim - rent paid 6 months in advance

Hi,

I am about to make an application for housing benefit for the rent I pay to an agent acting on behalf of a private landlord. I'm in the process of claiming JSA income based. I recently moved into this property, I am the sole tenant and the contract is between me only and the landlord. I'm not working now and I have an up to date rent contract available. However, I have paid the full rent 6 months in advance due to not being able to secure a place to rent without having a job (agent credit reference checks etc will have found this out). And private LLs in my area didn't seem to accept DSS tenants.

My question is whether this alone will affect the possibility for me to claim HB, i.e. I've paid the 6 months rent up front (£5000 which I borrowed from family) and will not be paying per calendar month until after 1st december 2010.

Can anyone advise me please.

Many Thanks.

so long as you have a valid tenancy then I can't see any reason why not - for example many people have to pay at least a month or two in advance when first taking a property and then go on to claim HB without any problems. Some landlords do request longer periods including the full six months as in your case and HB still seems to get paid.

Just to confirm that paying rent in advance does not disqualify you from LHA.
I currently manage a Housing Benefit service and have been working in Housing / council tax benefit (as was) since 2001.
