not following rules of dying intestate

my nan died in january and left no will, my uncle as yet has not distrubited any money, there wasnt an awful lot probably under 20,000.
my father is deceased so half should go to myself and 3 brothers.
do we have to pursue the matter as it never went to probate as he admitted to being able to get the money from the banks( there were 3) with just the death cert, or is there a governing body who we can report to for him not following intestate laws, or would we have to sue him through a solicitor

You could try phoning the local probate office for advice, I think your uncle should have applied for letters of administration.Signature removed for peace of mind0

Definitely contact the Probate Service on their helpline 0845 30 20 900. If the value of the estate is over £5000 they have to be notified. Sounds as if your uncle just took it upon himself to deal with things. There are strict rules about the distribution of assets in intestacy cases, and the proposed administrator shouldn't dispose of anything prior to Grant of Administration.0
