Single claim as a Landlord

My tenant has left the property on 01/06/2010 without giving me a months notice as agreed upon in the contract.

Contract was signed on 01/01/09 and was for 3 months and rolling afterwards.

He didn't give me any heads up and it was only around the 5th of this month when i didn't see the rent in my account that i sent him a text message that he told me that things weren't working out and that he had to leave and that the keys were in the postbox.

I said to him "NP but I would have to keep his deposit." He said it is fine. i have all thetext messages saved.

Now I have ordered the single claims form from the DPS.

I don't have the tenants current address and he is not answering my text message and phone calls anymore.

Do I have to give the tenant a 14 day notice for part of the deposit. I am talking about section 2b on the form.

Luckily, I have the tenancy agreement with me but it is not signed by a witness but I hear that is nit important.

Anything I should look out for?

    If you have been using the DPS, then when you are asked to present your evidence to the Deposit scheme, you need to write out the history of the tenancy and the reason you want the deposit back in a "Statement of Truth"and also write out the text messages in a separate "Statutory Declaration" - and then take them to a local solicitor and ask him/her to sign a Statutory Declaration as to the truth of the messages (costs £5).

    This should be yoru evidence. dont forget to include your tenancy agreement.

    If you use Mydeposits then just write a statement as to what happened for your own records.

    Is the amount of the deposit = to the amount of rent owed, and any damages?

    Strictly speaking, he should give one months notice ending with a rent period. Since he did not give notice until after 1st June (5th June text), then 1st July is less than a month. So he is liable to pay rent till 1st August.

    So he owes you 2 months rent, plus any damage there may be.

    TBH, i am fine with just 1 months rent cos i have already found a tenant from the 1st of july onwards.
