Refund on a broken/buggy video game?

Hallo

Today I purchased Red Dead Redemption for the playstation 3. Its fairly enjoyable but i have come across so many glitches and bugs in the game that it is no longer fun and fast becoming a chore. The many bugs within the game are widely documented on the internet.

My question is, am i within my rights to return the game and get a refund? because in my eyes the game is not fit for purpose, ie being able to actually play it without encountering any problems.

Any advice?

  • The shop may offer you exchange for another game, they may offer you a refund, they may just tell you to take a hike.
    A while back most games shops had a 7 day returns window.
    Long as you have the receipt then you can try.

    Fit for use is a bit of a tricky one where games are concerned.

    The disk and box and manual on the other hand are tangible and covered by the sale of goods act... maybe.
    Try, worst that can happen is they say no even after you mention the sale of goods act.
    As it's a PS3 game there is no activation code for online play is there? If not then the product can still be sold as "used" by the shop and they can make a little money or cut some of their loss.

    Moral of the story in MSE terms is to buy games a long while after release, check the status of updates and bugs and get it second hand.

    Moral of the story in MSE terms is to buy games a long while after release, check the status of updates and bugs and get it second hand.

    ...or for PC games wait a few months till its going for 75% off via eg Steam -at least that way some of the money stands a chance of getting back to the developer :)

    I've been playing it on 360 and I've yet to experience any really bad bugs. The odd !!!!!!? glitch.

    Suddenly being launched 100 feet into the air, then dying when I land.

    Accepting a challenge for a gunfight, then when it starts there's a sodding horse between me and the other guy, so I can't hit him with any bullets...

    Each of these has happened only once though, so they're rare enough to not be a problem. Load the last save and you're fine.

    If you bear with it, Rockstar will probably release patches for these bugs.

    I doubt you'd be able to argue that bugs make it not fit for purpose, unless it makes the game unplayable. I had a look online and there are some other odd bugs like flying people etc, but I don't see anything that would make missions unable to be completed etc, which would make it unplayable.

    If you can't wait for the patch, you are entitled to a refund under SOGA "Fit for purpose". There was a court case I remember reading in the last few months where someone won a refund because of software bugs.

    I got a refund after buying the infamous battlecruiser 3000ad years ago. 10 years in the making and buggy as hell. This was from instore at dixons or pc world.
