Got a letter from my landlord this morning...

    IF you had claimed LHA from day one of your agreement then this would be correct... but.. if i remember the claim was suspended and you lost entitlement for not having the correct paperwork..

    Yes, what happened was, when I finally got my tenancy agreement I asked for the LL to state my moving in date on the agreement - 298th sept. Then I took the hb application in along with the ta and then recieved a letter saying they couldnt backdate the payments as I hadnt sent the form in before I gave them my tenancy agreement.

    Thanks for replying clutton, I guess I was hoping that I would only have to pay the LL £495 plus whatever else becomes due between now and the end of the year, instead of the full £980... :o ah well.

    Ive also asked the LL for a statement of rent paid/owed etc so should hopefully get that by next week.

    With regards to the HB being paid in arrears, I gave a VERY simplified example, I have dealt with the HB people before when I had a lodger, I know they are not the most efficient people on the planet!

    I was merely illustrating the CONCEPT of HB being paid in arrears, not trying to relate dates etc. to alasia

    Things that still need to be sorted.

    1. I'm not convinced that you should be paying the extra £35/month. The full rent amount is not excessive for a 2 bed place.

    2. You need to talk to someone unbiased about your income support situation, if the rules were followed there is no way you should be getting only £40/week. £65 - 20% is £52 - 20% is the max they can deduct!

    3. Get a breakdown from the HB people of payments made, and ask them if they suspended the claim - they MAY have suspended the payments to fit in with a payment cycle to the landlord, but not the actual claim.

    4. You certainly owe the December payment - I'm dubious about the March one due to the HB issue - unless the HB people wrote to you and said they were suspending the claim


    Seriously - you need very good advice, about the whole issue from someone who can see all of your records, and tell them EVERYTHING including DATES. The figures I was working out assumed as you'd said that you split up in Feb and moved out - but you didn't move out until Sept. Gather every scrap of paper you can, and take it along - I am sure mistakes have been made by almost every party along the way - hopefully it will be put right.
    Unless it is damaged or discontinued - ignore any discount of over 25%

    I agree with that - it was my son's 5th birthday last week, and we gave him a new colouring book, set of felt tips, 2 books, and a Bob the Builder toy. Total cost was about £20, and he was delighted. We also had a train-shaped birthday cake my mother made, which he loved.

    Hi,sorry for posting again but I just got the statement of rent arrears that I recently asked my landlord for, and am confused...

    This is what it says:

    Oct/nov 09 £495 paid

    Dec 09 - rent paid - £300. Outstanding £195.
    Jan 2010 - rent paid - £470. Outstanding £220.
    Feb 2010 - rent paid - £0. Outstanding £715.
    March 2010 - rent paid £350. Outstanding £860
    April 2010 - rent due £297. Rent paid £450.Outstanding £707.
    May 2010 - rent paid £0 (council paid). Outstanding £707
    June 2010 - rent paid £0 (council paid). Outstanding £707
    July 2010 rent paid £100. Outstanding £607.

    He also sent a notice letter (of sorts) saying that the council pay him £469.16 but "this is every 4 weeks so you dont need to top this up".
    I dont undertashad that at all; the monthly rent is £495 so surely I need to still pay him the £30 or so that the HB doesnt cover? Is he saying here that I dont?

    I am also perplexed as the last notice letter he gave me (detailed in previous posts) said that I owed £981+ a few pence. So how come he now reckons I owe just £607!?

    I have no idea whether to take notice of this new rent arrears statement and arrange to pay him back the £607, or whether to query it with him - the last thing I want is him coming back to me in a few months saying he made a mistake and asking me for the extra £300!

    What should I do?

    If the landlord is receiving £469.16 every 4 weeks, this equates to £508.25 rent being received each month as there are 13 periods that he receives that for but remember there are only 12 months in the year (£469.16 x 13 periods divided by 12 months).

    People often assume that 4 weeks rent is the same as monthly rent but there are more than 4 weeks in most calendar months which is why they go out of synch.

    Have you looked into whether you are permitted to apply for discretionary housing benefit? I don't know the entry criteria for this but others will.

    The actual rent apparently is £495 per calender month, so that is £495 x 12mths / 365 days x 7days = £113.92per week is actually due

    Isn't the landlord being overpaid then by £10.12 as week?

    Sure someon more knowledgable about such matters will be along to correct if I am wrong

    At the risk of confusing things further if my maths is rusty....

    The weekly rate for a 4 weekly LHA of £469.16 is £117.29 (not £124.04). Calculate this by dividing the sum by 4.

    The weekly rate for monthly rent due of £495 is £114.23 (not £113.92). Calculate this by multiplying the sum by 12 months and dividing by 52 weeks.

    So there is a modest potential overpayment of a few quid each week which is not going to make much indent in the overall arrears.
