Made to Measure dress bought on ebay

I ordered a made to measure dress which was from China, the listing stated 4-5 weeks to make to specification, 2-4 weeks shipping. It arrived after about 7 weeks, measurements way way out. My hip measurement is 37", the dress was 46", Bust 41" dress 36". I took photo's of the dress with tape measure illustrating the problem. Apart from having to whizz out and get another outfit, (it was for a wedding) the seller insisted the measurements were correct but said to return the garment. It was a dress and bolero jacket. The seller now say they did not receive the jacket although it was in the same parcel and will not give me a refund. I have contacted Ebay who say, tough, their after sales only lasts for 45 days, which of course expired before I had received the garment. I paid by paypal and although I haven't contacted them yet, I understand that their policy is the same. Any idea what I can do?

There's not much you can do as you are out of the time periods for any dispute. All you can do is attempt to negotiate with the seller0

But surely, if as advertised, the item would not be available until after the 45 day period, a note should be on the site when making a bid. I can't even leave a comment to tell any other buyer to beware. In my opinion, the seller is saying they haven't received the jacket, which would not be of any use to anyone without the dress, just to duck out of paying the refund. The seller obviously is aware of the 45 day routine, so basically there is nothing I can do.0

Did the payment come via your bank, card, or straight out of your paypal account?
If it's a visa debit or above £100 then it might be worth getting onto your card provider.
You can use the section 75 protection, now technically it should fail as paypal is a middleman but some people have been lucky, some haven't.This is my opinion.
