    Well if nothing else anyone still reading has hopefully picked up something about the value of having good backups and perhaps avoid needing to test any of the legal arguments up for debate here.

    I'm going to leave things there.

    Law is quite comprehensible to technical people. Just not immediately to all of them.

    Thank you for all your help so far.
    The engineer knew not to take the hardrive and may have mistakingly took it, but he is now denying that he was told to leave it! Even though I told him I had paid for it and I had a witness there when he told me how I could retrieve the old data from it. Hence why I went out and bought a caddy at his recommendation to then plug it in, and they find he had taken the old HD.
    He knew not to take it, but still did (mistakingly or not) and now is lying to his employers.
    I knew the data wasn't backed up when it crashed, thats why I paid to keep it and now can't try to save the data, even though he told me how to rescue it.
    Ive paid out for caddy too, on his recommendation and now have it sat there with no use all because he took my HD.
    They said they would call me by friday at the latest, but guess what, Ive had no phone call.
