You'll have to fill out a TR1 and apply to the Land Registry - give them a call and they may be able to advise where you and get the forms fromCurrently studying for a Diploma - wish me luck
Phase 1 - Emergency Fund - Complete :j
Phase 2 - £20,000 Mortgage Fund - Underway0 -
thank you for replying
when looking on the Land registry I found the TR1 form was for transferring the whole of the title --- is this right ?
i want half in my name and half in his, so would I transfer from him to both him and myself?
also would we need to involve solicitors ?
many thanks0 -

Yes, XX transfers the whole of the title to XX and YY. You are not physically dividing the house between you which involve a plan and a TP1!
You will also need to complete an AP1 form and this involves providing either a certificate from a licensed conveyancer or solicitor that they have checked your ID or you personally attending at a Land Registry for them to do this. If going to a LR is a hassle then it may be easier to use a solicitor.RICHARD WEBSTER
As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.0 -
thanks richard for your reply, so in simple terms i need to fill out AP1 form which i can get from the land registry ( online im assuming?)
transfuring the house to both our names we are not dividing the house as which i originally thought....
still dont understand why and what type of certificate is needed and why?
sorry to be a pain
hope to hear back off you

Hey sorry to hijack BUT ......... I moved in with my partner (who owns his own home (mortgage) ) We are now married and have a child together! Can my name be put on the deeds? Or will it automaticly come to me should something happen to him? (God forbid)0

Its an indentification certificate which shows you are who you say you are. It's to protect the owner of the property (your partner)
On the TR1 the Transferor would be your partner and the Transferee would be your parter and you.
You can choose to be joint tenants (50%/50% and passes direct to survivor )or tenants in common (you choose what percentage you own and/or where your part goes in your Will/estate)
The AP1 is then filled out and sent to the Land Regsirty with the TR1 (and a copy normally) this is the form that changes the Title from sole to joint names. You have to have both the TR1 and AP1 to do so.Currently studying for a Diploma - wish me luck

Does he have a Will? This will say what he wants to happen. I think intestate laws normally mean that it would pass to you but a Will is simpler.
It you change the Deed to both your names as joint tenants then yes it would automatically pass to the survivorCurrently studying for a Diploma - wish me luck

yes he has a will and in that states that is any thing happens to him the house is to be left to me
i would rather be on the deeds tho just incase, it was half my money used for the house purchase in the beginning
so i think joint tennants would be the best option why and who is and why is it passed direct to survivor ( what does survivor mean?)
an AP1 form is to proove i am who i say i am, then need to fill out TR1 form to complete the process am i on the right lines?0 -
He says he has a will, But he has not amended it, i will have a chat with him, I am not sure if he knows, He may need to ask his mum (he WAS a mummy's boy) lol.0

Survivor is next of kin. (i think).
I seen somewhere on this board you can have another name on the deeds by going to a solicitor and paying £300. (few threads down i think)0
