Capital One charges over 6 years

can i just ask has anyone successfully claimed these charges back, mine go back to 2002, fos said they cant help just wondered if i should send letter threatening court

Do you have the details of the charges going back to 2002? If so then yes you can go through small claims court, Capital One usually pay up when court papers are filed. Not seen many on here but if you look on CAG cap1 forums quite a few people there who have sucessfully claimed back charges over 6 years old.

I have, I sent Martin's first template letter (they sent standard refusal letter) and followed it up with the second. They paid up - I think it took about three months tops, and they paid all charges including interest.

CAG is Consumer Action Group
I tend to bounce between these forums and those and they have specific forums for people who have or are in process of claiming from each bank so I'm finding the Capital One boards very useful as recently started claiming from them myself.
Am ok with that one since only from 2005 but a few others going back further which I think will be a bit of a pain, mainly because I don't still have the statements.
Would advise going through the small claims rather than the fos route as it seems to be a lot more effective.0 -
Went through fos and they replied that they couldnt help as its longer than 6 years ago, so dont have much hope really x0

I am going the court route rather than the fos route as it seems to be a lot more effective in this situation. I definately wouldn't give up on it, my Cap1 charges are within 6 years but have Barclaycard and Halifax credit card charges going back further and I fully intend to get them back
Like I said have a look at the Capital One boards on the Consumer Action Group forum, there are a lot of people on there who have successfully got their charges back from over 6 years ago and can help you out with what to say to Cap1 (or check the templates on here). From what I have been reading Capital One tend to kick up a fuss and then cave as soon as court papers are filed!
Am currently at the request stage with them for all charges plus contractual interest and if they make me file court papers (which it's 95% certain they will) they will get an extra 8% on it as well0
