DFS and the right to cancel a sofa

    Third paragraph there is of particular use:
    Today the salesman has phoned up to say we have failed the credit check and now we have to pay the full amount, today! Does anyone have any experience with this kind of thing? I'm sure there is a 30 day cooling off period etc, I have asked him to fax the details to me so I can read them as the paperwork is at home. Any advice on what I can throw back at them would be appreciated!!

    I tried that before myself but thanks anyway, there should always be a right to cancel anything this company are a disgrace.

    People always trust others when they are doing their job and it usually ends up to hardworking people getting the short end of a already impossibly short stick.

    Personally i'd take a desk chair, thermos, sammiches and sit outside their store warning everyone who went in that they would get you to sign a legally binding contract without making you aware of this and even giving you the impression you could cancel it. I would also point out the numerous problems that customers have had and tell them if they didnt believe me to "google it" (what can i say, i love google :D

    Of course prior to this, i would make the management well aware of what i was doing. But then i'm a stubborn cow :D

    Hi i dunno if you have read my threads on dfs but i can only suggest trading standards on this one and of course the judge at the sunday mail you can do an online form and he will reply within about a week and he will send a letter to them also.
    There were two of you and one of him so you have a witness to what he told you although dunno how that holds up in court when i bought my sofa i signed a contract which is the same one you have and your signing for the sofa not to hold it but to buy it as in cash or credit card etc without finance. They will try anything for a sale thats for sure i wouldnt set foot in dfs every again, i do know of one lady on here that failed the finance so she presumed that was the end of her sofa but no dfs went ahead ordered it anyway and twelve weeks later told her its here come in and pay its shocking the way they conduct business and i have no idea how they are still trading.
    Keep calm and fight till the end its a waiting game with them and ive heard of them cancelling orders for a price. check all threads on here about dfs. I feel your pain but your not alone let us know how it goes were here to support you and help if we can.

  • Got a result, my girlfreind phoned me really upset telling me that we cant cancel the order. Anyway in disgust and rage i phoned them and highlighted a few things, their sales tactics, the smoothering by their staff, the fact that i would be attending the store in person and would argue in full view of the store how we have been treated and make them look bad, asked them were they that desperate to sell a sofa and i also highlighted that i would go to the local media (which was my next step) and finally the fact that i stated to the salesman that if we werent handing over a deposit we were in a position to cancel the order at anytime to which the sales man stated we could.... This was a key factor and she went to the staff memeber who stated he remembers me asking this point and states he got confused with the fact that he thought i was talking about only being able to cancel through a solicitor or estate agent.

    The management of the shop has now therefore honoured my cancelation. What i will say to anyone DFS can cancel orders easily dont take on anything they say about legally binding contracts, we were conned and what i thought was a reputable business is nothing more then a cowboy organisation. This firm needs to seriously revisit there cancelation rights and also needs a good visit by watchdog.

    I will never go to this shop again they are only interested in one thing and that is money and customer service is of no relevance to them.

    Glad to hear you finally got a result :) Well done.

    I personally always take the viewpoint that if i'm not buying anything, i shouldnt need to sign anything. A price freeze should be sufficient with only their employees signature and a maximum of my name/address (which obv i could prove at a later date if required).

    Always be wary of anyone who claims you're not buying someone but still requires a signature.

    Help needed please!

    I went into SCS and found a corner sofa that was really nice. The corner sofa looked quite small and the sales person (who was the store manager) asked how we would be paying. Since there was no better price for paying up front we said the 4 years interest free option made sense.

    He suggested that we apply for finance to make sure we are eligible. He said if it doesn't fit it's not a problem changing or cancelling the order. Great! (plus I always thought I had a legal cooling off period so didn't think there would be a problem). So I filled out the various forms and went home.

    I measured up the space and found out there's no way it will fit in the room unless I have it on a different wall underneath the window, which would mean moving the TV. I thought about it and realised that the sun coming through the window would be a nightmare.

    I rang up SCS to say I'd have to cancel the sofa because it's too big. The store manager wasn't in but his deputy said I can't. I said that the manager said we could but the deputy replied that we could swap the sofa for something that comes to the same value. He then said I'd have to speak to his manager.

    I'm going to phone him tomorrow but I wondered where I stood.

    The contract says that within 7 days we can swap the sofa for something else. So if they use the "it's been ordered with the manufacturer" argument, I don't see why they'd let me change the sofa.

    HELP!!!

    DFS Cancellation Loophole
    If you order from DFS and realise within 7 days you wish to cancel because you have found the same sofa on the internet at a cheaper price or for what ever reason, than you need to follow these steps.

    On the direct debit paper work they will have on it in small writing you have the right to cancel your direct set up with DFS within 7 days...cannot remember how it was exactly phrased, but its along the same line...

    1) Cancel your direct debit with your bank.

    2) Notify DFS you wish to cancel and that you've cancelled the direct debit they've set up with your bank, however they will tell you you cannot cancel.

    3) You might even get a phone call afew days before the sofa's get's delivered, even though you tell them at that point you have cancelled, No doubt your delivery will still arrive. And when it does, Read the paper work and DO NOT SIGN FOR THE DELIVERY.

    It worked for a family member and also a few friends...Happy days...:T
  • Unfortunately cancelling a payment method is not tantamount to cancelling an order.
    Thinking critically since 1996....
