Help with small Claims

Hi

I am wanting to take Olympic Holidays to Small Claims court

I can't be bothered explaining my reasons, as it simply angers me

I understand that for a claim of around £450 it will cost me £30 fee to take them to court. However, how much are the court costs likely to be if I were to lose?

Also, how do I go about actually starting the claim. And which court would it be heard in (I live in Scarborough)

    I thought the whole point of the small claims court was that there were no aditional court costs?

    There will also be a hearing fee of £50.

    Check the contract you have to ensure there is not an alternative dispute resolution procedure agreed.

    No cost implication if you lose, it will usually be held in the court nearest to you, although the defendant can ask for it to be moved closer to their business premises if they wish, but there is no guarantee they would suceed with that request.

    You would be advised to show you have exhausted all avenues to try to resolve the issue with the company before taking action, and some courts offer a mediation service to try to keep the case out of court.

    What is your complaint against Olympic? Ash-related?

    Write to Olympic with a letter entitled "14 Day Prior Notice of Action" telling them that you will issue a County Court action unless they have resolved the matter to your satisfaction within that time period.

    Sit back and wait for their response.

    I did this with Nissan and it took them less than 5 days to offer me a brand new engine and pay for 9 weeks' car hire - about £8500 worth altogether.

    If I am seeking a part refund for issues with our holiday, can Scarborough County Court deal with this?

    Issue the SCC action online and it will be alloted to YOUR nearest County Court - which presumably will be Scarborough.

    It is almost unheard of (actually probably completely unheard of) for a business to be granted a hearing at a court nearer to them, because the Court would consider that the company can easily afford to travel to defend the action.
