Fraudulent Motor Insurance Claim

Explain it how you saw it to your insurers. Allow them to fight it.

My husband had a similar experience, though not a cyclist. A woman in a Mercedes company car ploughed into the side of him at a roundabout. He slammed on his brakes, preventing what could have been a nasty collision. She was ok, her car had a minor scuff mark which rubbed off easily at the scene, but my husband's van had the bumper ripped off as her tyre shredded it. They left on good terms- she admitted she was in the wrong and my husband bought a bumper from the scrapyard on the way home thinking oh well I'm about £20 out of pocket, poo happens and that was the situation dealt with.
A week later he gets a solicitor's letter stating that a claim was being made against him. He wrote back explaining what had happened and saying that he couldn't see what the woman was actually claiming for because no damage was done (other than to HIS van). That was 8 months ago and we have heard nothing since.
My husband should have informed his insurance company and taken photos at the time but hindsight is a wonderful thing. As far as he was concerned it was too minor to bother about.
All you can do is put your side of the story across and I hope logic prevails. As a result of experiences I've heard about like yours I decided to pay the extra £24 a year on my premiums for legal cover, just in case I need it. Good luck.0 -
A similar thing happened to me some years ago - the cyclist was injured, not my fault.
I mentioned to the police who attended that I may visit the unfortunate person in hospital just to see how he was - I was advised by them in the strongest possible terms not to do so as it would imply guilt.
The outcome was just a phonecall some months later from the police to state that no charges would be brought.
Nothing from him ( probably doesn't watch the commercial channels or have chav mates).
Its a sorry state of affairs that in this day and age that you can't help or enquire about someone who's come into 'contact' with you for fear of the implication of blame.0 -

I said:Yes we are all supposed to be aware of potential hazards but some people are a hazard to themselves. If we all drove at a speed that accomodated this it would be about 5mph.Totally impractical.More people would die from air pollution and old age than were saved in collisions.
Meaning if we all drove slow enough to react to every single situation we would barely be moving. There would be massive traffic congestion which leads to air pollution.
The old age bit was a joke, didn't think that would need explaining.
Driving is dangerous for everyone invlved but its here to stay so there has to be a balance between safety and practicality.0 -
