LHA-which rate?

I just need to know for definete whther i'm entitled to the shared LHA rate (which i'm getting now) or if i should be getting the 1 bedroom rate.

From what i gather if you are in reciept of a severe disability premium, you qualify for the one bedroom rate. I am in recipt of it on top of my ESA. But other things i've read say it doesn't count if you're on ESA.

Can anyone clear it up? Also if i was getting the wrong rate could i backdate for the amoutn i possibly should have had? tried looking at my local councilwebsite and the LHA site and neitehr has cleared it up

(have they also gotten rid of the keeping the £15 excess rule?)

edit: also does Mid rate Care on DLA change anything?

    Does anybody claim Carers Allowance for you? If not, you will qualify for the one bedroom rate. It is a fully rule, but here is the information from the DWP:
    If you are severely disabled, or live with a severely disabled partner, and have no dependent children, the one bedroom Local Housing Allowance rate will apply to you.

    By severely disabled, we mean that you have no one else aged 18 or over living with you or with you and your partner, no one gets Carer's Allowance for looking after you and you get the middle or highest care component of Disability Living Allowance.


    The £15 rule is still in effect, but may not be after the Budget today. You should be able to have any payment backdated because it would be their error, not yours.

    Thanksdmg24, No there's no-one to claim CA for me.

    Hmm

    Went in today witha change of address form and showed him the ESA breakdown and asked which rate i should be getting. He said it was for the "severelly mentally imparied" (guess i look to well...) and to assume i won't get it, that way if i do its a "bonus".

    I think i may have to go back tomorrow armed with this info
