Redundancy and rules surrounding notice pay

Options
I have been given notice of redundancy dismissal and have been told my last day of employment is 30th June 2010. The letter states I am due 8 weeks notice pay from 18th June 2010. It also states that I am required to work out my notice to the 30th June 2010. However I am being told verbally that if I find another job before this 8 weeks period is up I will loose my notice pay. Can you confirm an employer can do this or should I take matters further.

It is fair. Technically you are employed by them for that 8 weeks and should be available for work.

    PM i sent was incomplete.

Depend on PILON or garden leave get it clarified.

If they terminate you on the 30 June then they need to pay the outstanding notice as PILON,

If they put you on garden leave then if you resign before the notice is up they don't have to pay you.

Get it in writing they will still pay redundancy

When was the start date does the notice take you over another years service.
  • Have spoken to ACAS, I read them my letter and the adviser said it is PILON as they have not said in my final letter that I must be available for work only that I must work notice until 30th June. My employer probably meant one thing but because of how they have worded the letter they don't have much of a leg to stand on................. more fools them!!!!!! They are currently really encouraging me to find work and now I can see why I certainly don't beleive it is out of concern for me, but to SAVE them money, little do they know!!!!
