Advice on rental agreement notice period please

Hi all,

I'm renting a room in Sweden while I'm here for work. I am leaving in early July to come back to the UK. My rental agreement states exactly: "From 2010-04-10 and until further notice with 1 month's mutual notice time."
I told my landlord that I was leaving on the 9th July on the 8th June (more than a callendar month and 32 days from the leaving date).
I pay my rent on the 18th of the month and she wants me to pay for a full month rather than for the 22 days extra I will be here (22 days from the 18th June to the 9th July).
My opinion is that I have given more than 1 months notice so I am only liable to pay for the extra time that I am here, not an extra 8 days odd. Its not a huge amount of money (3000SEK/month, about £280 equates to a daily rate of 100SEK (about £8) so I want to pay 2200SEK for 100SEK x 22 days) but I need it :(

The 22 days comes from the time between the 18th of June (rent day) and the 9th of July (my leaving date). The 100SEK comes from the monthly total/30 days.

Any help or advice would be very much appriciated.

I'd be amazed if anyone knew enough about Swedish rental law to answer this, but in the UK your landlady would be right.

Why is that? Is it because a month is always a rental month, not a callendar month or 30 days?

Because standard contracts require notice to be given on rent day.

  • Ok, its just that those terms wern't explicitly stated anywhere in the contract, it just says one month. Hey-ho, its only £80...

    Thanks or the advice.

It's academic though, because you're in sweden, not the UK!

  • Well I can't imagine Swedish law is a million miles from ours. Its probably not worth getting myself into an argument over given that she lives in the same flat that I rent a room in.

Then in the UK you would be a lodger not a tenant so different rules apply. Seriously you need advice from someone well versed in Swedish law! Don't imagine or guess, find out.
