Possessory Title

Hi could anyone tell me that if you have been turned down on possessory title, when you can apply again.I bought a plot of land and the owners applied for possessory title on a piece that joined it.
They were refused as they had not fenced in or done anything with it.I have now fenced in the land and built a house on the plot which they had title for.I have had it for two & a half years, and they have made statutory declarations which amount to nearly 20 years.
I am now looking to sell the house and have been told that i could take out indemnity insurance (the piece of land is unregistered+any idea what the cost would be?)

i believe that you have to have actively owned and used a plot for 12 years before you are entitled to put in a possessory claim for it.... but i am no lawyer.....
  • If the previous squatters didn't get a possessor title because they didn't satisfy the Land Registry then their 20 years worth of stat decs are probably not worth anything. You will have to wait until you have been there 12 years without any adverse claims. Also you must not have been using the land with permission from anyone else.

I doubt if you will be able to get indemnity insurance until you can obtain a possessory title.

Also you have checked that the title isn't registered in someone else's name at the Land Registry haven't you?
