Hi can anybody tell me if I could claim for a mis sold warranty?
I bought a car on finance from Carcraft (biggest mistake) I told them that I definately did not want the extended warranty but they added it anyway, the car was bought with a personal loan, (I thought it was HP) from Creation Finance and the warranty was added to the loan without my knowledge of course. My paperwork has tick boxes to accept the warranty they are not ticked.

I can't see why not, if its mis sold then personally I think you should give it a shot in reclaiming.
You actually pursue the ones who set this up for you at the start, by completing the FOS questionnaire recently set up by the financial ombudsman service (FOS) for customers to use instead of letters, they have 8 weeks to respond in full, and remember to keep a copy of the questionaire as well.

You need to take it up with the finance company, as the dealer acts as an agent for them. The finance company should be on those agreement forms, so I would write to them and they will deal with it on their end.Best Regards

I posted the link to the questionnaire, but that is of PPI, so as zppp states take it up with the finance company and write a letter in your own words, tell them what you have told us and ask that they refund you.
They still have 8 weeks in full to give a decision.

The warranty is not a loan per se but a contract of insurance. If it has been included when it shouldn't the dealer is responsible unless they are acting for the insurer in which case the insurer will be responsible.
The lender has a liability too, though, under the Consumer Credit Act. Complain to the dealer in the first instance.0 -
Many thanks, do you know if there are any template letters I could use? I am not sure how to compose a letter as I have not done this kind of thing before but am now in a position where I need to.
PS. The warranty was all lumped in with the loan, I had salesmen coming at me from all sides and basically didn't know it was included they only tell you the weekly payment.0 -

I do not actually know of any template letters for this to be honest, on this actual matter, but just to give you an idea, although this is in regards of reclaimng PPI, it may be of some help to you.

Hi, the same thing has just happened to me this week at carcraft, i would have noticed but my parent decided to help me out and pay it off so i contacted the credit company for a settlement figure as I had decided not to have finance. to my shock the loan had gone up by £2000 in a day, so i complained to carcraft and it appeared I had the NAC Guarantee on my loan. Luckily I managed to get a rep that could advise me and i just had to write a letter cancelling the agreement and hopefully it will all be sorted shortly. Will keep you posted! I was like you though had clearly asked about this guarantee but decided I didnt want it. the rep even told me i could look at it again in a couple of years time if i wished.0

Carcraft absolutely ruined my life. At 19 I was browsing the Internet for a car and showed interest in a polo (not from a carcraft website) anyway a dealer from the leeds branch contacted me and asked if I'd be interested. He came and picked me up from my own home and drove me to the branch where I was swamped with paperwork and agreed to buy the car. The extended guarantee wasn't explained clearly to me, I signed the paper work but on the sheet I have it was explained as a TLC which is included in the price. It was only when I got home I realised I had actually been sold an extended guarantee of £1,795.00 that was additional. I was paying two separate rates of interest. They must of had a right laugh when I left the store. I contacted the man who had come to pick me up and said that I wanted to cancel the extended guarantee. He said that I needed to put it in a letter as a cancellation needed to be in writing. I did this and he said the man who drove me home would come and pick it up as I couldn't yet drive (a different dealer drove me home in the car I'd purchased). I was working the next day and my brother told me he'd handed the letter to the man that had come for it. I awaited a response from carcraft and tried numerous times to contact the man who had come to pick me up but he never answered. Eventually upon contacting the store I was met with the response that my cancellation period was over. I have written to carcraft about this before and have recieved the response that there is nothing they can do as I signed the paperwork. But let's just ignore the fact that I tried to cancel. If I could remember the name of the dealer that came to pick me up I would have confronted him. I was made a fool of at a young age and since then have been paying back two separate agreements because with this guarantee I couldn't receive the full credit from one finance provider. Nice one carcraft. Great customer service thanks for nothing.0
