second marriages/families/paperwork

Hi

Hope it's ok to post here - I wondered if anyone can advise. Me and hubby are shortly going to make wills and this has thrown up questions for which we don't know the answers. Mortgage company bit less than helpful, wouldn't give direct answers...

We have been married 6 months (2nd time round for both) and have a gorgeous 2 month old baby. I have 2 children from a previous marriage, one of whom I care for full-time due to severe disability (we get Carers Allowance, high rate DLA etc) making hubby the breadwinner. The house is his - his name on mortgage, deeds etc. He has no life insurance - was refused due to past medical issues which he is still :mad: about. When I moved in (we hadn't married yet) the mortgage company made me sign a form saying they could evict us if hubby died. Our slightly grim questions are:
- if hubby died can the mortgage company evict me and kids even though we are now married?
- if I died, where does my hub stand with the children? (there is zero contact or contributions from my ex)
- what stipulations do we need to make on wills?
- would 'mirror wills' do the job or are we too complicated!? (understand it's cheaper that way?)

    Please seek some advice from a solicitor.

    Its too bigger issue to take a gamble on!

    I think one thing is that your DH needs to get Parental Responsibility for YOUR children. That should be helpful even if you don't die ...

  • Thanks. I will take the advice of a good solicitor. Re-reading my post makes my family sound like a bit of a tangled mess but we are all very happy and functioning in our own funny way - just goes to prove life may be swings and roundabouts but the ups are there too... :)
