If you are bankrupt and get a windfall, don't you have to declare it to your OR?0

In 30 mins a solicitor should not be categorically telling you what you should be claiming in Ancillary relief (finances). There are procedures in place for full disclosure and any solicitor worth his/her salt would say that this is required before they can even think about advising you on your entitlement.
If he is telling you to go for a Pension sharing order (ie you get 1/2 her pension each month) then I'm afraid this is not looking like it will be amicable for long. Unfortunately, without knowing more e.g your ages, kids ages, whether you work now, how much you both earn, how much the house is worth, how much you intend to give her, the value of your windfall, the CETV of the pension etc etc, I dont think anyone here can advise you whether you should be going for her pension (and possibly spending £1000s on legal fees and Court proceedings thereby cancelling out any potential gain and maybe diddling yourself out of some of your windfall and share of the house in the process). You need more than 30 mins free legal advice or you need to walk away and keep the house and the windfall save some money on extensive legal fees and retain your amicable relationship with the ex which is often more important than money especially when you have a child/ren together.Proud Mummy to Leila aged 1 whole year:j0
