Tiscali/TalkTalk change of contract

Hi, I joined Tiscali at the start of December 09 on their broadband/free weekend package. This costs me £15 per month.
Today, I received a letter from TalkTalk stating that I am being moved on to their 'Next Generation Network' and that my package will now be broadband plus free evening and weekend calls at a cost of £18.48 per month.
I do not make calls of an evening, and so do not require the new contract and subsequent price hike. Are TalkTalk allowed to change my contact, which after all was taken out with Tiscali, or can I state that I have a contract with tham for £15 and that is what I would like to hold them to.
I do realise that there is a rider in TalkTalk's contract to say that they can do and charge what they like, but as I say, my contract is with Tiscali.
Many thanks, Mark

LLU (Next Generation Network) means not BT Wholesale resold as Tiscali was....that consumerwise means it should get cheaper ! £15 or NO CONTRACT is your legal stance. If I helped or saved you money - Thank me
If I helped you spend some money - spank me
If I done both - :lipsrseal me:eek:0 -
They have done this to me and im paying £4.99 a month now Unlimited and they want £18.48 a month from the end of July and this is 40GB Capped
I rung them told them im not intrested in this and im happy with the £4.99 and they told me that they want me to come over to talktalk and them to take over my line so i said no thxs they said they they would send me a Mac Code
Now i rang 02 to have telephone broadband but my phoneline is not recognised whats that all about?
They have told me to go to Postoffice and get a line?
Can talktalk change your contract just like that
Thxs0 -
You need a non Talk Talk line (non LLU line) sometimes a little misleadingly described as a "BT line". The Post Office can set it up for you, then you can have O2 broadband on it. It's the same bit of wire, it just plugs in somewhere else at the exchange.
No, they can't just change your contract. They propose a change, which you either accept (by doing nothing) or reject (and then the contract ends)0 -
Cheers Mark
Any idea how much the post office setup is?
Thxs0 -
Post office want £110 for me to swap over
Any other way?

There's a system called "Return to Donor" which carries a lower fee, but the implementation of it seems to be far from clear and might require you to use BT. If that's not an issue for you then ring them and see what they say.0

Might be wrong but if talktalk are sending you a mac code doesnt that imply that you are on a bt line, is your £4.99 for unlimited only for broadband? if so who do you pay your line rental to?sanfly0 -
I have received a price increase from Tiscali in February. I was paying £14.99 and then it's gone up to £19.99 and one month was £22.08. They say they sent me a letter in November 09 to inform me but I didn't receive it. Friends on the same package are still paying £14.99 and haven't had a letter. I asked TalkTalk/Tiscali how that could be and they say I was just first on the mailing list. Lucky me!! So, I get to pay more for longer because I was mailed first!!?? I complained to head office - complaint rejected of course. They said as part of the migration process some customers with have a decrease, some an increase and some would stay the same. Is that allowed? I asked them to send me a copy of the letter from November but they say they can't because they were all computer generated!!!!0

Also beware, I have just checked my latest Tiscali (taken over by TalkTalk) bill and questioned charges on there, they have put the inclusive call time from 6.00 pm to 7.00 pm like BT . I don't remember having been advised of that by letter or email #StaySafeWishing you a Merry Christmas and a happy, healthy New Year0 -
Hi All,
To clarify as part of the acquisition of the Tiscali brand this is being integrated into TalkTalk.
This initially began with the rebranding of Tiscali to TalkTalk. In terms of the contract/plan changes this is a rationalisation process to integrate all ex-Tiscali customers onto TalkTalk Plans.
The mailing contains a suggested plan based on previous requirements. As advised this in some cases will lead to an increase, decrease, or no change in price.
In the event you are not happy with the proposed new terms under your consumer rights you do not have to agree to the proposed changes and are entitled to cancel the services without contractual commitment in light of the changed terms.
Unfortunately due to the large number of plans Tiscali had in circulation it is not feasible to retain all of these in future, hence the rationalisation of plans is proposed. IN some cases there will be a suitable work around in terms of the changes to the plan and an agreement can be reached to continue providing service.
In respect to the migration of services, Nick smith, if you have been issued with a MAC code then you are not on an LLU line and would not require a New Line or Return to Donor as the MAC code is sufficient for you to migrate. If you are having problems with this please register and post on the TalkTalk Members Forum (<http://www.talktalkmembers.com/forums>) and we can investigate into this.
Mark_In_Hampshire - You are correct in terms of the Return to Donor process, I would however note that depending on the plan chosen with the Return will denote if there is a contract term applicable. It is advisable to check this with BT prior to any changes being made.
