i bought a leather sofa bed for £900 in april 2007 , in 2009 the arm developed a fault and i contacted f/v and under the 5 year warrenty f/v agreed to replace the arm and they "ordered " the new part long story short they took 4 months and still no repair . i challenged them sucessfuly quoting the sale of goods act and that that i had given them a more than reasonable time to carry out the repair and i asked them to eithier refund me the money or replace the whole sofa.
The plumped for replacing the whole sofa that was in march and they wrote a letter to confirm what has agreed , but now i'm in the same position and still no replacement sofa they keep fobbing me with it should be delivered the end of may start of june middle of june what can i do ?? i threatened them before with legal action and small claim should just go ahead and start a claim this has been ongoing since nov 2009 and i'm getting totally fed up ....

When you threatened legal action, did you give them a deadline? Oce you threaten legal action, you have to follow through or they think you are a paper tiger.
Do your research on making your claim, write again, tell them you will start legal action in 14 days - and follow through.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
hi,
yes i did give them deadline in nov called to report fault they came and looked at it the first week of dec then they promised to have a replacement arm in jan/feb got to the end of feb and nothing so i wrote them a snotty letter ( recorded delivery to the head office) and gave them 10 days to repair or replace they then opted to replace it. was told i would get my replacement in may then i was told start of june 3 weeks ago but have heard nada from them so i'm guessing they dont have it yet but interestingly enough ive checked on the web site and they dont even stock the same style anymore so i dont know where they are getting my replacement from ?? but as ive said they have been extremely quiet ie no phone calls to let me know whats happening so i'm intending to give them until the end of june and then hit them with a 7 day letter to come up with the goods or refund me in full. The only problem is i have 2 matching sofa's so if i get rid of 1 i have to get rid of both of them can i force them to ake boh of them back on the grounds they were sold together and i cant get another matching sofa as they no longer stock them and i dont want 2 odd sofa's ??
I have not had a working sofa for now 9 months by july if i file a claim at small claims what are my chances ??? can i also get some compensation as ive sent letters / made loads of calls etc and i feel that i'm due something for the inconvience. ??!!!

I would be writing to them again now... not waiting to July. Tell them what you expect to happen and when.
As DVardysShadow says, you have to carry out your threat.0
