advise - my guttering in neighbours garden

I live in an upstairs maisonette, I share a rear garden with the occupants downstairs and the guttering that leaves my property is attached to a wall in their side of the garden, I've come home tonight to find they've been decorating their garden and have tied stuff onto the guttering, im guessing they shouldn't without at least asking? after all if it breaks it will be me paying for the repairs! would just like to check I have a right to moan first before wading in and seeing as last time it broke it dripped through their bathroom ceiling I don't really want it happening again

I assume they are leasehold ? If so there is usually a contractual clause that you are both responsible for the exterior of the building and that would include roofing, guttering pointing etc. At least thats how it was with the maisonnette we used to live in. If thats the case you are both responsible for repair of any damage to the guttering, you may want to check the paperwork on the property first before you talk to them.0
