Repair Warranty

Hi All
Looking for a wee bit of advice please. My son recently had his faulty Xbox repaired by a local company at the cost of £60, and it lasted for about 14 days. The shop had orginally given him a 30 day warranty on the repair (as stated on the receipt, which we have). He took it back that day - and well within the 30 day warranty period - where he was told that his Xbox was unrepairable, and that the company would give him £40 to take it off his hands!!!
Can I ask for a refund of the £60 legally.
Any help much appreciated.

Was it the same fault?If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

Well it was these 'Red Rings of Death' but I don't really know if that's the same fault or not???0

Depends if it's the same fault that has reoccurred or another one.
Considering it failed within 14 days then I'd expect my repair fee back unless they present a good case that the second fault is clearly different to the first.
The thing is without an independent inspection it's difficult to decide one way or the other - for instance, if the second failure has absolutely nothing to do with the first then the repairer shouldn't have to refund since they've done nothing wrong, but if it's the same thing or they damaged something doing the first repair then obviously they owe you.
See what they say if you go back to complain and be reasonable and calm about it. Don't get angry or worked up, that rarely helps.
Worst case if you want to push it is to make a Small Claims Court case against them and pay for an independent report. If you win you're get the cost back.
I guess you've already checked whether the xbox was covered by Microsoft's Extended Guarantee programme for RROD issues?0
