As the OP I'd like to add a thank you to you hudson for your clarifications and also to toffe for taking the time to engage.
I can see now that my original case was flawed in places; however thankfully I had a Judge on the day who was fair and found in my favour as my basic argument was sound, and Comets behaviour was outside the law.0 -

Cheers, i never had anything against you, just felt best to clear up some minor details for future use.
I do applaud how much you did learn on your own though. Just need to remember you cannot rely on eu directives and the right to rejection is only a reasonable time. The 6 months mentioned being the burden of proof for the retailer to prove the item wasnt inherently faulty.
Toffe seems to be hit and miss but he can be right time to time.
I think most judges know what happens in these situations and i wouldnt be surprised if they had a judgement in mind before actually hearing the case. Most actions against comet and dsgi is because of their blatant disregard for the SOGA so most judges will know about this and act accordingly.Back by no demand whatsoever.0
