Employment and Support Allowance advice

Hi,

My gf has health problems which caused her to leave her job in December.

She got the courage to go to the doctors this week and he gave us a sick note for the next four weeks.

Can she use this to claim benefits and if so can I go to the job centre and get it started as soon as possible?

    Has she paid class 1 NI payments for the last 2 1/2 years or so?

    If she has the relevant contributions she can claim contributions based ESA because she has a fit note but be aware it very hard to pass the medical.

    Do you work and if you do how much do you make?

    Your situation is relevant if she hasnt paid enough NI contributions and you will be assessed as a couple, the same goes for the medical on either ESA claim.

    You claim ESA by phone.

    She should claim ESA straight away

    You wont be able to make the claim on her behalf unless she gives consent for you to do so on the phone or you fill in an ESA1 and get her to sign it.

    She moved here from Italy last May and worked from June till December so I doubt she has enough contributions.

    I work full time and earn £27,500 per year.

    If she has not paid enough contributions and you live together she will not receive income based ESA.
