6ft FENCE planning permission?

Hi There,

I live on a corner plot detached house, I have a front, side and rear garden, i have a defective wall that needs to come down which seperates my side and back garden, i want to take this wall down and put a 6ft fence up around the perimiter of my garden to increase the size of my garden by about a third (by merging side and back garden)

My gardner has told me that i do not require planning for a 6ft fence, does anyone know if this is true? I live in scotland, any advice i am extremely grateful

    You need to ring your local planning department in the council and ask them....they are the ones you will be in trouble with if you, if you do put it up and need pp...........

    I think that a 6 foot fence is fine for diving gardens, but if it faces a public highway you can only go to 3ft before you need permission.
  • In England, if the wall fronts a highway (and that includes pavement, verge etc), then the maximum height is 1 metre. In any other case it is 2 metres. Not sure if the legislation in Scotland is the same, but it's likely to be. If the fence exceeds those heights, you need to apply for planning permission. However, if you replace a like-for-like wall or fence then you also don't need to apply for planning permission in England (regardless of height) - so replacing a 2m high wall adjacent to a highway with an identical wall is ok, but replacing a 2m high wall next to a highway with a 2m high fence is not ok.

    Sounds like your intended fence could face a highway, as you're on a corner plot - so it could well need planning permission (as it will exceed 1 metre in height). Also, some estates/houses have conditions on them preventing the erection of fences forward of the dwelling - if you live in an open-plan area - so do check previous planning permissions as well. May just be simpler to ask your Council!

    We have wall in houses by us that are 6 feet high. The great big old houses have them, I guess it means if you can afford a great big house you can have what you like.

    I'm in Scotland too and I strongly urge you to contact your local council. It's been my experience that there is a big variation in what's permitted where.

    All the houses round here (private and council) have 6' high fences round the outside perimeter of our gardens irrespective of whether there is a road or pavement there or not. However, we weren't allowed a 6' high fence to divide us from next door. We could have a 6' x 6' 'privacy panel' at each end of the fence as long as the bit in the middle was no higher than 4'.

    Sometimes I think whoever is in the office at the time just makes it up. :rotfl:

    If it's on a corner, then one issue is visibility from any side roads. People approaching the junction/corner need good visibility beyond the corner.
