Should letting agent have told me about noise?

Hi

I moved into (rented) a flat about 10 months ago and everything is fine apart from one thing, there's a scrap yard 100m from my flat.

Now, they start work without fail at 7:30am every morning (except Sunday, I really look forward to the lie-in's) and the noise is terrible, Imaging tonnes of metal being moved and dropped meters from your bedroom window. Sometime it's like it's being dropped in my flat! This carries on throughout most of the day until 5pm.

There's no chance of sleeping through it, not even with ear plugs, so it's really starting to bother me now, especially as I've recently changed my working hours and don't really need to wake so early.

My real point is should my letting agent have made me aware of this? Can I do anything about it? Does anyone know the laws regarding noise?

I intend to call my local council soon, I just wanted some opinions first.

    I'm guessing the scrap yard is not hiding itself so it's not like anyone actively hid it from you

    7:30 is reasonable trading hours. I doubt you wull get anywhere with the council.

    I'd stick it for a while and work out how fast you can give notice and move out. But no, I don't think anyone has pulled a fast one here.

    You didn't notice a scrap yard when you viewed the property? Why didn't you ask?

    It's hidden by a line of trees, in the autumn the leaves fell off and it revealed itself to me.

    I had the same feeling too about it being reasonable hours of work but I'll still be calling my council.

    Moving out has already crossed my mind, it's a nice flat and nice area but I may have to.

    Why didn't you walk around the local area? Or hear the noise when you viewed the property?
  • Calliing the council? What do you expect them to do? Shut the yard down? See options in above posts.

    Have you tried WAX ear plugs? They are massively better than foam ones if you fit them well.

    Be gentle, it's my first time renting so I know I was a little naive.

    Maybe there was a lull in their day, I caught them on a lunch break or a day off. Whatever the reason I didn't notice/hear any noise.

    It's not exactly signed, off a small road down a little alley.

    Why not ring the council? You would call them for a barking dog, noisy neighbor wouldn't you? i pay them enough money so I'm at least going to bother them for 10 minutes.
  • It's your time, and your council tax.

    Dogs should not cause a nuisance in their typical activities, same applies to neighbours. Industrial noise of the kind you experience is normal in the opporation of the business. If it were a railway line, you wouldn't expect them to divert it would you? And trains are noisier than dogs.

    If it was quiet when you viewed with the LA, how would he be aware of the noise?

    What do you expect them to do? Shut down a business because you didn't do your research? What world do you live in?
