Guy need some advice,
Accident 1 year ago on round about, not my fault. 3rd party has claimed against me, I have no claim (have since sold the car). Recieved a county court summons for their repairs £1000. Insurance company offered 50/50, 3rd party declined. I have now recieved a letter stating that in 28 days I will be issued a county court judgement if I dont pay.
What happens if the insurance company dont sort it out in time? Im guessing I will foot the bill??
Any advice would be great,

Pass all correspondence unanswered on to your insurer (at the time of the incident) to deal with. They should deal with the court too. (As the letter is a judgement against you, what did you do with the initial summons you received?)0

Well, I was informed by the inurance company that they would 'deal' with it an I need not reply, clearly that didnt happen. Hence I'm thinking that after speak to the insurance company tomorrow I may need to speak to the court and inform them of the situation?
A little dissapointed in the insurance companies laid back approch to be hinest, 28days to act not sure it will be dealt with in time!!!0 -

They will sort it, even if you end up with a judgement! Unfortunately its a regular occurrence, and they don't appreciate the stress caused when a judgement drops through the letterbox. But there are ways the insurer will use to get the judgement struck out, and the case restarted. You won't be out of pocket, and all court costs will be borne by your insurer.
But escalate this to a manager.0 -
I will be speaking to the file handler and the manager tomorrow. I guess they work with this kind of stuff every day, however its not their personal record which is on the line!
Thanks for your advice guys, I'll let you know what they have to say tomorrow.

Have you received genuine court documents or just a letter with threats?
You can only get a CCJ if you lose the case and then dont pay up, If you goto
court and they dont win then you pay nothing.
I would goto court and just say the insurance are dealing with or have dealt with
them and they are idiots taking you to court and not your insurance company.Censorship Reigns Supreme in Troll City...0 -

In cases like this the summons is correctly taken out against the individual, not a third party to the incident (which the insurer is).0 -

Unfortunately the lawyers who get referred the case could also
make a mountain out of a mole hill to ramp up their fees.
I had a wing mirror clipping once. My mirror was fine, but the other car's mirror cracked. Exchanged details, informed the insurance company. As far as I was concerned, I was not even claiming, as I had no damages, but the lawyer started asking for evidence and was claiming "damages" against the other insurance company!0
