I regret to say that I do not read that as being at all that clear. I think you are reading what you want it to say - not what it says. It does not stipulate the terms of the employment at all. You really need to go back to the contract signed with the agency to determine whether she is an employee or not. As I said previously, I am afraid that I have come across this type of arrangement far too often, and I am very sorry to say that it is legal - it shouldn't be but it is.0

The law is very clear on adverts & actual pay & holiday pay.
Hence a major agency having to pay out hundreds of thousands of pounds some years back as a result of "thinking" they were acting legally in the way they paid & advertised rates.Not Again0 -

I think you are missing the point. This is not, it would appear, an "agency" which employs people - they are contracting for service with self-employed people. I am not saying this is "right" - just that it is the case. Somewhere in all the paperwork that the OP has signed will be an agreement that she is self-employed and a sign up to the umbrella company. She probably didn't read all the paperwork closely - many people don't, they just sign. Self-employed people are not employees and therefore do not have the same protections. All of this should have been made clear to her in a tranparent way - it obviously wasn't. But you cannot become a member of an "umbrella company" without signing up - so somewhere she has done this, probably without realising it.
Pretty disgusting practice, but far from unusual now I am afraid.0 -

I agree she probably got load of forms (which you do when starting a new role) and signed up somewhere along the line?
Do you have a copy of all your signed contracts (this is what counts the most unfortuantely - they can not mention the umbrella at all and just get your signature then they are covered).
It is unfair of them tricking people like that. I'm sure there is some regulatory organisation that deals employment agencies that this could be reported to? Maybe contact the Office of fair trading?!"£$%^&*()0 -

It is illegal to advertise a position for a pay rate that includes holiday pay without making it clear.
Whatever happens after that is irrelevant. Especially for an agency acting for a client that is in fact itself.Not Again0 -

A company membership isn't an exam. The company must agreed to comply with their guidelines and pay a membership fee.
