Getting caught driving without a licence
Hello all,
I am posting this as mainly curious. one of my colleagues was caught last week driving her partners car by the police. She has no licence and obviously no insirance. She was cautioned and will now have to appear before magistrates. Her partner also has to go to court as he allowed her to use the vehicle whilst knowing she only had a provisional licence. She is obviously upset and is worried what the penalty will be, whilst I do not condone what she has done, I do want to try and help her out so would appreciate any information people may have or any experiences they may have come across.

Will prob attract a penalty of 3-6 points and a fine (max £1000).
Court could disqualify her which stops her from obtaining a driver's license for a set period in the future.
I suppose she could also be charged with driving with no insurance which would carry more points and head her closer to receiving a ban on driving.

If she has a provisional, she does have a licence so the offence will be driving other than in accordance with her licence (i.e. unsupervised, prob no L plates ?).
The "No Insurance" offence is the serious one and will get her 6 points and a large fine. Her partner will have a summons for "Permitting No insurance" which carries the same level of penalty0 -
Her partner also has to go to court as he allowed her to use the vehicle whilst knowing she only had a provisional licence.
The partner will be charged with permitting use of the car by an uninsured driver, which is 6-8 points and a fine.
Long term this will also have a big impact on his insurance premiums for years to come.0 -

Both will get done. She will get up to 12 points which means when she gets her licence, she'll be banned. He'll get 6 points. His insurance will rocket for the time the offence is on his licence and she'll be basically uninsurable for a good few years as well.
Don't bother to help her out because, apart from the fact people like her should be locke up and don't deserve it, there's nothing you can do.0 -
One question that hasn't been asked yet: Did her partner actually give permission for her to drive the car? Or did she take it without asking him?
I'm glad she got caught. I reported someone for this only today. People who abuse the system only bump up costs for the rest of us.0 -
I have unfortunately been in a similar situation when i was younger ,typically the offender will receive £100 fine and 3 points unless a disqualification is granted ,if this is the case you will look to get banned from driving for around 6 months ,no points but you will be fined again around £100 ,as for the owner of the car ,you can expect a fine of again £100 and 3 points or a 6 month ban for letting an uninsured driver use your vehicle ,this info is based on a 1st offence ,the severity will be based upon the judge themselves and some are worse than others. we all make mistakes

Hmm, genuine question here, I'm feeling a bit thick this afternoon (it's the heat) but wouldn't her licence be revoked as she has got over 6 points? Or do those points have to be aquired after passing?
