Accident advice please

Hi

Just wondering if anybody can advise on this situation.
i will quickly recount what happened 24th feb this happened
My partner was in tesco car park waiting for a car which was reversing out when, he was stopped with engine running, when another car to his left reversed from another space and hit the car off side. She was young upset, called her dad, Partner went got groceries came back father was there. He said we will pay - not to go through insurance. Ok my partner said , My car is quite old anyway young girl had private plate on her newer micra,

The result was a buckled and dented wing, smashed light cluster, Partner got 2 quotes one came in short of £600 ( from the garage which normally services our car ) and another for just under £300. He put the quotes to the father who said he did not expect them to be so high, explained the wing had to be replaced as buckled. He said he would get a mobile panel beather to come and see car, told him when we were available, etc.not more than £150. My patrner not being the pushiest person in the world agreed, it was too late to go to insurers And My policy expired 28th feb i changed to another insurer.

We moved house 3 weeks after and it was not top of our priority and so we called a few weeks later, Father surprised thought the car was fixed??? I spoke to him this time told him we had been fair not asking for the rediculous amounts just wanted car fixed, He said his daughter was a student did not have much money.....( our car is 16 years old but serviced regular as clockwork and has never let us down we both are hard working with a young family and dont have spare cash either ) but she had a 2 year old car and a private plate... I said i just want the car fixed, she should take resposbility, he said he would arrange for someone to come again.

Well now we are in June no one has been he has not been in touch, car not fixed ( although we had to have the wheels reallinged ) I am annoyed they are getting away with this,

I have been told we can go to the small claims court anybody had similar problem? I have tried to read about the small claims court but cannot make heads or tails of it! Mentions meadiation and things before going to court.

We have been reasonable, my partner was calm and agreeable to what they wanted, I am sure in the future he will not be so when someone dings the car.

We have tried phoning but no response. I have typed a letter recounting the above to send recorded delivery with quotes, giving them 7 days to respond but not sure if I can state I will go to the small claims or not as Never done anything like this before. I dont wnat her to get away with it, and dont mind persuing it, its really getting to me.

    You can go directly to their Insurers and instigate a claim off them

    As dachouch says you can go directly to their insureres but be warned you must inform your own insureres even if you are not claiming from them. If you dont and they find out they could invalidate any future claim from them
    Why dont you let your own insurance company persue them for you.

    Hi

    Thanks for the response, I changed insurers on 28th feb as renewal was up, for a better deal so I am no longer with the same insurers, so that complicates things for me. I dont have her insurance details only her name and address, but if i get them can I go straight to her insurers without having to go back to my old insurers. ( policy my name partner named driver fully comp )

    You can find out the name of her Insurers and their contact number along with the policy number for a small fee from this website providing you know the reg https://www.askmid.com

    The chances are the other person has not reported the accident to them, when you ring the Insurers they will take the details and then contact their client for their comments

    & there is a lesson for the future.

    Do what suits you, don't try & do people favours or be amicable.

    Get an independent witness & trust no one.

    I know MY partner is a big softie ,I was at work, she shed a few tears Blah blah, I know he wont be like that agin, hes never had an accident before. and just wanted to do what was right I guess, he has had his Lugs pulled ! ( it has been the cause of a few rows )

    I would still maintain that you should inform your new insurance company and ask them for any advice, Like I say,
    If you go through their insurance they will want to know all your details re your insurance and they will also inform your insurance company. If you dont, you are just asking for trouble in the future.
