Question regarding Car Insurance renewal

It's renewal time for my Car in the kolin household.
however i'm trying to work out what I should put with regards to a claim I made in Oct 2008. (I was unsure on my first renewal who was to blame)
Basically I wrote off my previous car into a stone wall (sounds pretty obvious at the moment!), however the van in front of me at the time (it was slowing down (to about 10mph, as if stopping), and pulling over to the left, so i indicated to overtake, the van then performed a U'y without any indication as i was in the process of overtaking and I had to swerve, and ploughed myself into a wall.
I unfortunately didn't hit the van.
So, for insurance purposes, it was an accident, but who was to blame?
Myself?
Other party? (bearing in mind i didn't actually hit them, and therefore they sustained no damage, so technically not involved?

this still agreives me by the way. I am now classed as a bad driver for insurance purposes (having lost 4 years of no claims), and the guy who was driving the van is a good driver.0

Well I would say it's 100% your fault.
The van had right of way not you.
However don't get bogged down in my opinion.
What did the insurer say?
Surely you reported what happened?
Did you ask them about trying to recover the losses from the van driver?
Did you provide them with any details e.g. reg number, or is it an unindentified vehicle?0
