Paying for a service which is not being supplied

I think this might be the right section, but I'm not too sure.

I live in an apartment building and pay a maintenance fee to Solitaire for a combination of cleaning, building insurance and other bits and pieces.

Since I've been living here (for a year now) I've never seen a gardener maintaining any of the greenery around the buildings. This greenery doesn't belong to any individual, so it's not like somebody has let their garden get unruly.

The outside of the building has become a bit of a shambles, overgrown with weeds, strewn with rubbish and has garnered comments from family and friends who have seen it.

I called Solitaire to get a gardener to come and sort it out and they told me that they don't have a gardener assigned to my area because the developer hasn't handed over to them yet.

I checked what my service charge covers, and it includes garden maintenance. The building has been finished and lived in by some people for 2 to 3 years who have been paying for the garden maintenance, but haven't received it.

Does anybody think I'd have grounds to claim some of the fee back from Solitaire as they've not been providing the full service as described in their price sheet?

    I would have thought so.

    The question is how much time and hassle will it be, will you get any help from the others etc. It could be a lonely battle.

    Who is responsible at this stage the builder or the management company? They will both probably claim the other.

    Good luck though.
