Hi
Thank you for the reply.
NID did say that the agreement looked unenforceable. So we have to wait and see
I did receive a letter from cabot putting an offer to me of 200 off the original debt of 719. Don't know if this offer is any good or not.
I will write to the FOS and see what they say.
Thank you for your help

The FOS will handle disputes.
But the FOS will not decide on court matters, such as is the agreement enforceable or is a debt statute barred. They will just state a judge must decide on it and they will not help. So be sure any complaint to the FOS is justified on solid grounds that are not for a court to decide.
Remember if an agreement is not enforceable, they can hammer your credit file and still ask for payment. They will just fail to get a CCJ in court.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

The FOS are a waste of time for most things so I wouldn't waste your time.
If it's unenforceable then you've just got to sit it out and ignore their threats because that's all they are.0 -
While I am sure debt help charities help some people. They told us we were bankrupt years ago, if we had listened we would have lost our home. Instead we completed our self run DMP, can afford a holiday this year and have credit which is perfectly manageable.
We could have ended up in a bedsit or tower block somewhere miles away.Barclaycard 3800
