How to get out of EA contract

After having my flat with an EA for 9 months with only 1 viewing I decided to go with someone else, but my EA is demanding I honour their contract which stipulates they get 30 days notice.

The problem is that the day I cancelled they removed me from their website and rightmove and only now 8 days later have they put me back on rightmove minus pictures and not even on their website.

I did a phantom call asking about properties in the area and they didnt even mention mine (the cheapest in the area). I pushed it and they did mention it but said it needed a lot of work (a complete lie!!!!) and went on to press the negative points.

Now I'm going to get on to their boss to hopefully get out of the contract early as they are obviously not selling it, I am wondering if their are any estate agency rules or legal rules I can quote?

They are in the National association of estate agents

    I dont know specifically about contracts, at the end of the day if they are making no effort to flog your place ( 9 months!) then wht difference is 20 odd days going to make?

    Have you spoken to the manager about this?

    I dont know anything about getting out of contracts, but presumably you are not paying them anything?

    I dont know if the sale of goods & services act might help you here though, might we worth a quick ring to trading standards to find out??

  • The thing is its a frustrating 3 weeks for me seeing WC DAWSON of Stalybridge damage the name of my property and openly brazenly not bother.

    It is no sale no fee.

    thinking about this some more, I wonder whether the Data Protection Act might be some use, Ie you can stop them using your data and ask them to remove all your details from their computer system

    Im sure this is a long way round the houses, have you spoken to the association?
