Hi,My wife is off work sick and we are wondering if she will be able to get ssp through her employer.Her average wage is above the threshold needed but she does not have a contract of employment and her hours change week to week because she mostly covers holidays and sick days etc.She has been with this employer since 5th April.Any advice would be great.Thanks in advance Simon

Provided that all rules for notifying sickness, and providing evidence of sickness if required, have been followed; then if the employer is not paying SSP they should issue a form SSP1 which gives the reason for non-payment.
If they dispute that you were sick, or you disagree with their decision not to pay,you can refer the case to HMRC; but must first try to resolve with the employer.
The period during which you need to have average earnings of at least the lower earnings limit is the last payday before the sickness begins and the seven paydays before that one (eight in total) assuming you are paid weekly.0 -
